Your affectionate brother Praghosa here. I am no legal expert but the
"legal" arena is not unlike any other "arena" where combat is arranged.
There is a challenge made "I am going to whip your ass my good man and
more importantly - for the following reasons!" tal tal tal....
Then the accused transgressor steps up - if he is man enough. Nothing
in this world is given...it must be won and then sustained.
In this case, the BBTI vs BBT case was NEVER ADJUDICATED in court.
NEVER really settled. There is the "appearance" of settlement only.
The settlement itself is a GROSS VIOLATION of the TRUST established by
Srila Prabhupada. This makes it illegal.
The facts as I understand them are clear. The legal teams for both
sides of that suit conspired to steal over 1 million dollars of Srila
Prabhupada's money and ELIMINATE HIM as the actual "original" owner of
his copyrights. They "settled" outside of the court's jursidiction and
basically BACK ROOM BULLSHIT and this resulted in the copyrights being
provided to the GENERAL PUBLIC, despite what anyone might offer as
protest. Offering Hansadutta 'license" when they did not legally
possess the authority to do so - like me offering you your car -
constituted an atttempt to prolong the PUBLIC FRAUD perpetrated upon
all of ISKCON'S CONGREGATIONS. The BBTI laid "claim" to the "ASSETS" OF
A LEGALLY ESTABLISHED TRUST. THIS act alone constitutes a FELONY, ONE
FOR WHICH ALL WHO AUTHORIZED SUCH FRAUD COULD HAVE BEEN FORCED TO SERVE
TIME IN PRISON.
There is much more to all of this, but the impotant thing to consider
is this:
Raising $100,000 to pay lawyers would only be necessary IF THE MEN WHO
STAND TO GO TO PRISON FOR ILLEGALLY CLAIMING TO HOLD TITLE TO THE
STOLEN ASSENTS (THE COPYRIGHTS OF HDG) ARE ACTUALLY WILLING TO
CHALLENGE THE PRINTING AND DISTRIBUTION OF SRILA PRABHUPADA'S BOOKS. MY
own opinion, for what it is worth, is raise 1 million and then simply
print all the books, and tell the Felons to find another gig!!
They are all bluff. They know - each of them knows - they committed
serious crimes by following the likes of Hari Kesa Swami. He led them
down this dark path and by dint of their association they are now
completely implicated in his crime.
THEY ARE ALL BLUFF AND ALWAYS HAVE BEEN. WHY ANYONE THINKS THAT
JAYADWAITA AND THE REST WOULD PREFER PRISON TO THE DHAMA - AT THEIR
AGE? ARE WE KIDDING OURSELVES?
THEY ARE ALL BLUFF...JUST SMOKE.
LET THEM CHALLANGE "WE WILL SEE YOU IN COURT! (THE ARENA)
WON'T HAPPEN.
THEY HAVEN'T THE "SAND" FOR THIS FIGHT. THEY DIDN'T THEN. The Judge
himself said they would be crushed like a bug." AND THEY CERTAINLY
DON'T NOW. (This was when Federowsky switched sides and attempted to
extort a cool half million! That jerk needs a whooping in the not too
distant future by the way.)
FOR WHAT IT'S WORTH, WE SHOULD JUST RAISE THE MONEY AND TAKE OVER.
They only way for them to stop it - is to go into court and hang
themselves.
They don't have anything to gain from that. NOTHING.
The so-called settlement was illegal.
The BBT is an IRREVOCABLE TRUST. The BBT is Srila Prabhupada's own
handiwork and cannot be brushed aside. Hans Kary is its legal Trustee.
This is all legal fact.

This is just my opinion, Prabhu. I do not believe they have the balls
to risk jail, and jail is indeed what they risk. They lied. They lied.
They lied. This is the simple fact that they cannot circumvent.
Someone should simply spell it out to them in plain English: "Prabhus,
This will not be over till the Fat lady is singing the lullaby that
puts 'em to sleep in Lampoc. Just act wisely and not make it worse for
yourselves."
Personally, I do not believe that Svavas Prabhu and a couple of others
ever willingly wanted to cooperate with the idiot Hari Kesa. I remember
him distinctly holding serious malice towards this "wrecking ball" of a
Guru Wannabe shmuck way back in '88. I think he could be convinced to
do the right thing without putting $100,000 in the pockets of lawyers
again! He was railroaded then and should be offered amnesty and
friendship if he just steps up and acts correctly.
Just some thoughts for what its worth.

I have some questions:
1) If the BBTI was closed down could they not open under any another
name and trade.
b) could they not have as empty premises operating under a Mr Das
company USA and transfer the operation to eg India and export to all
ISKCON temples from there. Printing books in Singapore/China and
exporting temples direct under different name.
2) If they closed the BBTI could they not go to - say India or any
other country where they can operate from as they still have the
monopoly as they got supply agreement for ALL of ISKCON temples.
3) If the operation was to enforce them to print Original Srila
Prabhupada books - they may decline as they may not get megabucks that
the BBTI is making them.
4) Lawyers - I have not much faith in them - they may say fees less now
- but may put some proposals - later - to convince that they have
another plan please give more. What do you do then?
